Informed Consent Agreement
for a Psychic Experiment

About The Psychic Experiment

Picture of a psychic in a crystal ball Welcome!  Sometimes called clairvoyance, remote viewing is the ability to psychically receive information about places, people, things, or events located miles away, or even in the future.

In this experiment, you'll have the chance to use your psychic abilities to perceive information stored on remote computer(s) that are far away.

(If you are not sure whether you have psychic abilities, that's OK!  We're hoping to study a broad range of people, and who knows, you might discover for the first time that you're psychic!).

In order to ensure safety during Covid-19, the experiment will be conducted entirely via the Internet.

This study was authored by Scotch Wichmann, a Parapsychology graduate student studying how technology and paranormal abilities may intersect.  (You can read more about Scotch and the study here).

About This Agreement

This Agreement is between you ("you") and Falcon Shamanic Healing & Magick LLC ("us", "we", the "researchers," or the "Company"), a limited liability company in California that researches ESP, remote healing, and other paranormal topics.

Description of Experiment and Data Collection

During the study, you will be asked questions about your beliefs and past experiences involving extrasensory perception ("ESP").

You will also be asked for your first name and email address so researchers can communicate with you. You are permitted to participate in the study more than once, but each participation will require you to supply an email address that is unique. We will only use your email address for communicating with you.

The experiment has three parts. In each part, you will be asked to use any psychic abilities you have to perceive information about "targets" (words, numbers, photos, etc.) stored on the researchers' computer(s).  You can also draw pictures of psychic impressions you receive, which you can upload, email, or text to the researchers, if you choose.

The researchers reserve the right to change the targets at any time, and to present situations and targets that appear real, but which are actually simulated.

By visiting the experiment's website, additional information may be collected, including information about your web browser, IP address, geographic location, web pages you visited, and the amount of time you spent answering questions (collectively, "telemetry information").

Your privacy is very important, so we minimize the personal data we collect, and we don't purposefully collect information about other websites you may visit.

To learn more about our data collection and use, see our Privacy Policy at: https://www.psychicexperiment.org/privacy_policy/

Data Use and Copyright Permissions

The researchers plan to make their study results public, but data you provide will be reasonably anonymized, which means that when you provide us with your questionnaire answers, texts, emails, pictures, telemetry information, and other data collected by the researchers (collectively, "data" or "your data" or "the data" or "experiment data"), we will mix your data with other participants' data to help obscure where the data came from, and we will also remove your name and email address from textual data prior to any publication.

Since the research data is so critical to the study's success, you expressly grant the researchers and their assigns a worldwide, non-exclusive, irrevocable, royalty-free, fully paid-up license in perpetuity to use, analyze, store, transmit, share, sell, publish, perform, promote, and otherwise make public your data (excluding your name and email address in textual data) without limitation and in any medium or format, and without attributions or copyright notices citing you, since results are intended to be anonymous.

Writers and artists often have unique styles that are readily identifiable. So, while the study's results are intended to be anonymous, you agree and accept that we can't guarantee your anonymity, and you release us from all liability if the public identifies text or images you submit as being authored by you. If your anonymity is important to you, we suggest using a writing or drawing style in your submissions that is different from your typical style, and avoid the use of text or images commonly associated with you.

You are encouraged to submit your data to the study in a timely fashion because the researchers are permitted to conclude collection of the data at any time without advance notice, after which any data not yet submitted will not be eligible for submission and inclusion in the study.

While the researchers intend to publish the study results, they are not required to publish, nor to make the data or study results available to you or any other party, except for certain cases outlined elsewhere in this Agreement.

If your data was included in the study, you'll be emailed a copy of your personal experiment results after the study has been concluded and all data has been analyzed. By participating in the study, you give us permission to email you.

You are encouraged to let people know on Social Media or elsewhere about your participation in the study, and the researchers (who are the copyright holders of this experiment and its website) hereby permit you to publish any text, images, screenshots, or video from the experiment website, provided that you attribute the study's website URL (https://www.psychicexperiment.org/) and its author, Scotch Wichmann.

Independent Judging

Psychic impressions you provide during the study, including text you write and pictures you draw, will be shown to a panel of independent judges who determine if your impressions match the psychic targets you were aiming for. Each impression you provide will be judged by three people whose scoring decisions will be combined.

To protect your identity, judging will be blind, meaning judges will not be shown the name and email address you used when you signed up. However, if you include information in your writings or pictures that identifies you (such as your name, email address, a picture of you, etc.), then judges may be able to discern your identity, so we advise not including any personally identifiable information in your writing or pictures, if your anonymity is important to you.

Judges' identities will be kept secret before and during judging, and judges' scoring decisions are final and at their own discretion. Judges may choose to reveal their identities after the study is complete.

Exercising Your Rights

You have many privacy and data protection rights outlined in our Privacy Policy.

However, because data integrity is so important to our scientific study, you expressly permit us to set certain limits on when data is allowed to be changed or revealed to the public, in order to avoid skewing or corrupting experiment results during or after the study:

Random Drawing / No Reimbursement

Our budget is limited, so you won't receive financial payment or other reimbursement for your participation in the study, but if you answer all of the questions in the experiment such that the data you supplied becomes part of the study results, you will be entered into random drawings to win one of three digital Amazon gift cards (commonly known as e-cards), with each card having an available balance of $200 U.S. dollars.

To be eligible for the random drawing, our database must show that you completed the experiment completely when we cease accepting new data from the public, so be sure to continue in the experiment until you reach the "Thank You" page. You agree that due to the Internet's inherent limitations (e.g., network outages, lost network packets, cached web pages, etc.), you will not be eligible for the drawing if your data in our database is found to be incomplete when the data is analyzed by the researchers. You accept that our database is the sole source of evidence proving participation (that is, we won't accept emails, text messages, screenshots, network logs, or other forms of evidence proving participation).

Three study participants randomly chosen by us will each win one gift card, and you are only allowed to win once, even if you participate in the study more than once, so if your contact information is drawn more than once during the drawings, your second winning drawing will be discarded, and drawings will resume until three unique people have won.

The three winners will be chosen randomly from the pool of eligible participants using a digital random number generator (DRNG) in the year 2022 after the study has finished gathering its data from participants, and the three winners will be notified by email.

If you are a gift card winner, (i) we will make reasonable efforts to contact you several times via email, and once we have confirmed your email address with you, we will email your winning card to you via Amazon; (ii) you agree that the researchers shall not be held responsible if you do not receive the email(s), since the Internet and email providers are not always reliable, and you are responsible for ensuring that the email address you provided is accurate and working; (iii) you are responsible for protecting the card's data like any financial instrument and using the card before it expires, and the researchers shall not be required to issue additional or replacement cards for any reason; and, (iv) the gift cards have no cash value, no gift card or gift card balance may be exchanged or refunded for cash, and no cash will be provided to any participant.

The following people are not eligible to win gift cards: (i) researchers or judges or other people involved in administering the study; (ii) study participants who live in jurisdictions where such random drawings are unlawful or where drawings require registration with, or financial payments to, any governing body; (iii) any study participant whom the researchers, in their sole discretion, suspect was engaged in cheating or fraud, including, but not limited to, the use of automation to increase odds of winning a gift card.

Note that if you send us anything through SMS text messages, toll charges may apply, and we're unable to offer reimbursement for those. The same applies if you mail or ship us anything via postal mail or by courier — unfortunately due to our limited budget, we can't offer reimbursement for any postal, shipping, handling, delivery or other fees of any kind.

No Warranty

The researchers offer no representations or warranties regarding or associated with the experiment or your participation or experiment outcomes or publication or usefulness of results, express or implied, either in fact or by operation of law, statute, or otherwise, and you disclaim any and all implied or statutory warranties including warranties of merchantability and of fitness for a particular purpose.

Release of Liability

Your participation in the experiment is entirely voluntary and fully at your own risk, and you agree to hold harmless the researchers, their collaborators, and their assigns from any liability, loss, or damage you may suffer directly or indirectly as a result of your participation.

Governing Law

You agree that all claims arising out of or relating to our Services and this Agreement will be governed by California law, excluding California's conflict of laws rules, and will be litigated exclusively in the federal or state courts of Los Angeles County, California, USA.

Severability

If any part of this Agreement is held or made invalid by a court decision, statute, rule, or otherwise, the remainder of this Agreement shall not be affected thereby.

Your Agreement and Consent

You agree that you have read, understood, and consented to this Agreement, and any questions you had about the experiment or this Agreement were answered to your satisfaction before you gave your consent.

By visiting the experiment's Internet website on the Internet at https://www.psychicexperiment.org/ or by participating in the study, you agree to the study's Privacy Policy (available online at https://www.psychicexperiment.org/privacy_policy/) and Terms of Use (available online at https://www.psychicexperiment.org/terms_of_use/), which are both included here by reference.

By participating in the study, you consent to this Agreement in its entirety and certify that you are at least 18 years of age.

By clicking on the checkbox on the experiment website's signup page at https://www.psychicexperiment.org/ that reads, "Yes, I accept the Experiment Agreement and want to participate," you are legally signing and entering into this Agreement electronically in lieu of a handwritten ink signature.
